Terms of Services

These Terms of Service ("Terms") govern your access to and use of the Zic VPN application and related services (the "Service") provided by CANTHO SONG NUOC LIMITED COMPANY, operating as Zic VPN ("Zic VPN," "we," "us," or "our").

By accessing or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

Eligibility

You must be at least 13 years old, or the minimum legal age required in your jurisdiction, to use the Service.

By using the Service, you represent and warrant that:

you are legally permitted to use the Service;

you are able to enter into a binding agreement;

your use of the Service complies with applicable law.

The Service

Zic VPN provides a virtual private network service intended to help protect internet connections and improve user privacy and security.

The Service is intended to provide secure connectivity and does not guarantee access to any specific content, service, platform, or website.

The Service may include:

mobile application features;

account and subscription features;

backend systems used to authenticate users and manage service access;

VPN provisioning and configuration systems;

support and service communications.

We may offer free features, paid plans, temporary or limited-access features, and pre-release features. Service availability, performance, server locations, and supported functionality may vary by region, device, network, subscription status, and time.

Accounts and Access

To use some or all of the Service, you may need to create an account or sign in through one or more supported login methods made available in the app, including Apple Sign In, Google Sign-In, or similar authentication flows.

You agree to:

provide accurate and current information;

keep your account credentials secure;

keep confidential any VPN configuration materials, QR access codes, or similar access credentials made available to you;

use only the access and sharing methods we expressly permit.

You are responsible for all activity that occurs under your account.

You must not share your account, credentials, or VPN configuration materials except through product features that expressly permit limited sharing.

Acceptable Use

You may use the Service only for lawful purposes and in compliance with these Terms.

You must not use the Service to:

engage in unlawful, fraudulent, deceptive, or abusive conduct;

gain unauthorized access to systems, networks, devices, or accounts;

distribute malware, harmful code, spam, or exploit tooling;

harvest credentials, personal data, cryptographic keys, or other security-sensitive materials;

attempt to circumvent or interfere with service limits, subscription rules, or security controls;

interfere with the Service, our infrastructure, or other users;

resell or commercially exploit the Service unless we expressly authorize it;

violate export control laws, sanctions laws, or other applicable trade restrictions.

You are solely responsible for ensuring that your use of the Service complies with all applicable laws.

Use of VPN services may be subject to additional legal or regulatory restrictions in certain jurisdictions, and you are responsible for complying with those requirements.

Subscriptions and Purchases

The Service may offer free and paid plans.

If you purchase a subscription through Apple, Google, or another platform provider, billing, renewals, cancellations, and refunds may be handled by that provider under its own terms and policies, except where applicable law requires otherwise.

Pricing, billing cycles, feature availability, and any applicable service limits are displayed at the time of purchase or in the app, where applicable.

If the Service supports subscription sharing, that sharing is limited to the seat, device, or user limits we make available.

Privacy and Service Data

We process limited account, subscription, operational, and technical information necessary to provide, secure, and maintain the Service.

We do not log, store, inspect, or analyze browsing history, DNS query content, or the content of internet traffic transmitted through the VPN tunnel.

Third-Party and Platform Services

The Service may integrate with or rely on third-party and platform providers, including Apple, Google, Firebase-related services, hosting and infrastructure providers, and operational support providers.

Those providers may have their own terms and privacy policies. We are not responsible for the independent practices of third-party or platform providers.

Beta and TestFlight Terms

If you use a beta, test, or pre-release version of the Service, including a build distributed through TestFlight or another Apple-controlled pre-release channel, that version is provided for evaluation purposes only.

Pre-release builds may contain errors, incomplete features, temporary limitations, or compatibility issues. We may change, suspend, or withdraw pre-release builds at any time.

If you obtain or use the Service through Apple, you acknowledge that:

these Terms are between you and us, not with Apple;

Apple is not responsible for providing maintenance or support for the Service;

Apple is not responsible for claims relating to the Service except as required by law;

Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to your use of the app obtained through Apple, and may enforce these Terms against you in that capacity.

Intellectual Property

We and our licensors own the Service, including its software, backend systems, technology, documentation, branding, and related materials.

Except for the limited right to use the Service in accordance with these Terms, no ownership rights are transferred to you.

You may not copy, modify, distribute, reverse engineer, resell, sublicense, or otherwise exploit the Service except as permitted by law or with our written permission.

Suspension and Termination

We may suspend, restrict, or terminate your access to the Service if:

you violate these Terms;

you engage in illegal, abusive, fraudulent, or harmful conduct;

your use creates security, legal, operational, or abuse risk;

we need to comply with law, platform requirements, or provider obligations;

a provider, backend dependency, or platform channel requires us to limit, pause, or withdraw the Service.

Suspension or termination may occur without prior notice where reasonably necessary.

We may also restrict or modify the Service to comply with platform provider requirements, including Apple App Store policies.

Disclaimers

The Service is provided on an "as is" and "as available" basis.

We do not guarantee that the Service will be uninterrupted, error-free, available in every location or network, or secure in an absolute sense.

Zic VPN is designed to improve privacy and security, but we do not guarantee complete anonymity or protection against all threats, attacks, blocks, or tracking methods.

The Service is not intended to provide guaranteed anonymity or to enable unlawful or untraceable activity.

You are responsible for maintaining appropriate security practices on your own devices and for protecting any credentials or VPN configuration materials made available to you.

Limitation of Liability

To the maximum extent permitted by applicable law, CANTHO SONG NUOC LIMITED COMPANY and Zic VPN, including their directors, officers, employees, affiliates, agents, contractors, and service providers, shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your access to, use of, inability to use, or reliance on the Service.

This includes loss of profits, revenue, goodwill, data, business opportunities, service interruption, connection failures, performance issues, or other intangible losses, even if we have been advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law.

To the extent liability cannot be fully excluded, our total liability shall not exceed the greater of:

the amount you paid for the Service during the six (6) months before the event giving rise to the claim; or

USD 100.

Indemnification

You agree to indemnify, defend, and hold harmless CANTHO SONG NUOC LIMITED COMPANY and its affiliates, officers, employees, contractors, and service providers from and against claims, liabilities, damages, losses, and expenses arising out of:

your use of the Service;

your violation of these Terms;

your violation of applicable law or third-party rights.

Governing Law and Disputes

These Terms are governed by the laws of the Socialist Republic of Vietnam, without regard to its conflict-of-laws principles, except where mandatory consumer-protection laws of your country of residence provide you with additional rights.

If a dispute arises, you agree to first contact us so that we can attempt to resolve it informally. If the dispute cannot be resolved within a reasonable period, it shall be submitted to the competent courts located in Vietnam, unless applicable law requires otherwise.

Nothing in this section deprives you of the protection of mandatory provisions of the law of the country in which you reside.

Changes to These Terms

We may update these Terms from time to time.

Where required by law, we will provide notice of material changes. Your continued use of the Service after updated Terms become effective constitutes acceptance of the updated Terms.
